Conservation Commission Meeting Minutes

• Meeting Called To Order at 6PM

• Public Input for items not on the Agenda: Monica Montferret, Lake Management announces Lake Management meeting schedule for 2-14-23 and they have invited Solitude to the meeting regarding considering recommending new chemical for treatment of Milfoil.  She also expressed concern about Bubbler apparatus safety.

• Review of Meeting Minutes 12-13-2022: Huntoon motions to approve minutes, Litchfield seconds, Vote 3-0, Mitchell abstains.

• File #181-0284, Notice of Intent for providing additional parking along the East Branch of the Housatonic River (Riverfront Area) at Old Mill Road (Map 101, Lot 16) Applicant is Berkshire Natural Resources Council: Emily Stockman, Stockman Associates is present representing applicant and provided an overview of the entire project.  Mitchell motions to issue Order of Conditions with conditions; follow all plans & information provided in the Notice of Intent application, notify Commission after installation of erosion controls to inspect and approve prior to the start of work, notify Commission after completion of work to inspect prior to removal of erosion controls, and the Order of Conditions shall include a continuing condition in the Certificate of Compliance for projects under 310 CMR 10.58(5)(f) or (g) prohibiting further alteration within the restoration or mitigation area, except as may be required to maintain the area in its restored or mitigated condition.  Prior to requesting the issuance of the Certificate of Compliance, the applicant shall demonstrate the restoration or mitigation has been successfully completed for at least two growing season, and shall provide a deed for the Conservation Restriction for Mitigation off site within the same watershed, and applicant shall submit a statement from a Professional Engineer certifying substantial compliance with the approve plans and special conditions, Boudreau seconds, Vote 4-0

• Request for Determination of Applicability for installation of a yard hydrant within Buffer Zone of Ashmere Lake at 337 Ashmere Road (Map 112, Lot 52) Applicant is JeanMarie Iwanicki: Boudreau motions for negative determination with condition that soil is stabilized until hydrant is installed, Litchfield seconds, Vote 4-0.

• File #181-0285, Notice of Intent for proposed repair to top of retaining wall along Ashmere Lake for 337 Ashmere Lake (Map 112, Lot 52) Applicant is JeanMarie Iwanicki: Boudreau motions to issue Order of Conditions with conditions; Dispose of all material according to all applicable laws & regulations, & work to be done after drawdown is completed, Litchfield seconds, Vote 4-0.

• Update of Enforcement Order for Ashmere Road (Map 112, Lot 157): Mitchell updates Commission on site visit with property owners with Commissioner Boudreau.
