  1. Meeting called to Order at 6PM

 

 2. File #181-0077, & File #260-0014, continued public hearing from 7-9-19 for Request for Amendment for Ashmere Lake Herbicide Treatment.  Applicant is the Town of Hinsdale.

 

There is no representative from Solitude present at the meeting.Frederick stated Lycott used airboat with jets underneath vessel to spray herbicide directly into water.Frederick asked if there are any other certified operators?

 

Conry asked about hydroraking, Mitchell stated primarily used in areas of swallow water, doesn’t uproot any plants, only removes excess material.

 

Frederick states he is not discounting herbicide treatment, since it targets specific species.Koch states the reason not to treat later is because of the camps.

 

Mason (Select Board Chair) stated that she had contacted solitude and they acknowledged the problem this year, but they did respond immediately after contacting them.

 

Frederick motions to continue to 9-10-19, Tremblay seconds, vote is unanimous.

Koch motions to continue to 9-10-19, Bruce seconds, vote is unanimous.

Bruce states the need to contact Solitude of the date, time and place of the next scheduled meeting.

 

3. Public Input for items not listed on the Agenda.  Michael Gervasi asked about obtaining certificates of compliance for previous Order of Conditions. Mitchell explained the process and after the meeting is concluded will meet him in the office to see whether certificates of compliance where issued previously.  Jodi Quimette, Lake Management Committee informed the Commission that a Request for an Extension for the Ashmere Lake drawdown will be made for the next meeting.

 

4. Minutes of Meeting 7-9-19; Bruce motions to approve, Cederholm seconds, vote is unanimous.

 

5. Request for Determination for 0 Peru Road (Map 113, Lot 158) for installation of proposed seasonal dock. Applicant is Thomas Warren.

 

Jackson Alberti from Foresight Land Services is present to represent the Applicant.Alberti stated that the proposed dock is a temporary seasonal installation and will be removed each year.The propoed dock is aluminum with composite decking reaching 24’ out into Lake with 8 feet sitting on the bottom of the water, so there will be no alteration of Land Under a Waterbody.

 

Koch motions to issue a negative determination #2, Bruce seconds, vote is unanimous.

 

6. Notice of Intent for 110 Watson Road (Map 405, Lot 41) Applicant is Kimberly Wendling.

 

Mitchell reports that the Applicant’s representative requested a continuance.Koch motions to continue until 9-10-19, Cederholm seconds, vote is unanimous.

 

7. Interview Joseph Horton for appointment to the Hinsdale Conservation Commission.

 

Conry asks why he is interested in becoming a member of the Commission; Horton replies that the environment is important to him, he is an outdoorsman, fly fisherman etc. and he would like to serve the Town, which he lives in full time.

 

Bruce motions to endorse his candidacy to be appointed by the Select Board, Koch seconds, vote is unanimous.

 

Old Business

8. Enforcement Order 134 & 80 Maple Street; Continued discussion of the drafted Invitation to Bid for a wetland delineation of the site etc.; Members decide on a specific date on bid response, specific date for site visit, specific date for submitting bid, and specific date for opening the bid by the Hinsdale Select Board.  Bruce motions to allow Agent to send out Bid with specific dates, Cederholm seconds, vote is unanimous.

 

9. Correspondence: Mitchell informs members of membership form from MACC.  Each member gave information to become members of MACC.

 

10. Mr. Craig Walton asked question related to filing a RDA for a proposed project.  Mitchell explained the process.

There is no representative from Solitude present. Chair Frederick from Peru Conservation Commission stated for the record that both the Peru & Hinsdale Conservation Commissions issued Emergency Permits for herbicide treatment of the Lake due to unforeseen circumstances.Frederick also stated that information/spreadsheet for warm and cold water species to be treated (listing of species) was supposed to be provided by Solitude.Frederick said that in lieu of no attendance or information by Solitude, he motions for continuance until August 13, 2019, Tremblay seconds, vote is unanimous.Hinsdale Conservation Commission member Bruce motions for continuance until August 13, 2019, Cederholm seconds, vote is unanimous.

 Mitchell informs members that the applicant has withdrawn their application.

   5. Emergency Permit ratification for File #181-77; Mitchell states that all special conditions of the order of Conditions were applied to the EP. Bruce motions to ratify EP, Cederholm seconds, vote is unanimous.

   6. Emergency Permit ratification for File #181-86; Mitchell states that all special conditions of the Order of Conditions were applied to the EP.  Bruce motions to ratify EP, Cederholm seconds, vote is unanimous.

   7. Discussion of Joint Meeting Policy:  Chair Conry stated that she thought it was a good idea to have some rules for joint meetings.  Bruce stated that the rules have to orchestrate the meeting to be fair to both Commissions.  Chair Conry thinks the chair of the host commission should orchestrate the meeting to have questions go through.  Public questions go through the host chair with both Commissions having the capacity to answer questions.  Members agree that the meeting should be orderly without conflict.  There should be equal opportunity to make comments with some kind of time limit.

   8. Discussion, Review, and possible vote of Request for Letter of recommendation for Mallory Marcom.  Due to legal ramifications, there will be no discussion of this item.

   9. Reorganization of Commission/Nomination of Chair/Vice Chair: Bruce motions to nominate Conry to be Commission Chair, Cederholm seconds, vote is 2-0 with 1 abstention.

 

Old Business

  10. Enforcement Order Plunkett Reservoir Road; Continued from 4-29-19; Members had decided to require Town of Hinsdale to install straw wattles & a temporary berm to protect resource area until Town replaces culvert.  The Town of Hinsdale did put protections around culvert.

  11. Enforcement Order issued to Town of Hinsdale for violation at 134 & 80 Maple Street; Members discuss how to resolve enforcement issue at the Town Highway Garage site.  Continued discussion of using conservation fund with contribution from Town of Hinsdale to solicit bids from engineering firms to complete survey of wetland line, and conduct site visits with engineers to determine scope of work.  Mitchell submits bid proposal for members to review.  Conry requests motion, Bruce motions to move forward with bid proposal with added line on permanent markers with copy of violation included with bid, Cederholm seconds, vote is unanimous.

  12. Correspondence; Mitchell informs of email received from Eversource regarding RDA for 1185 New Windsor Road for inspection of property at 2PM on 7-11-19;  AE COM representing City of Pittsfield (Cleveland Reservoir Diversion Project File #181-0242) submitted a sequence of work as required, and is in the process of installing erosion controls.

•Applicant's representative reviewed proposal to replace 2 existing transmission structures along line 312 (Right of Way), which will require enlargement of footprint with work pads & access roadway to facilitate the structure maintenance work. Members discuss special conditions; Installation of entrenched silt fence with staked straw haybales, contact Commission to inspect and approve prior to start of work;.After construction of access road & expansion of construction pad area, applicant shall inspect erosion controls to make sure they are secure to prevent erosion of sediment into wetland resource areas; After completion of work contact Commission to inspect if removing erosion controls; Cederholm motions for negative determination with special conditions, Bruce seconds, vote is unanimous.

Review of Meeting Minutes for 4-9-19: Bruce motions to approve, Cederholm seconds, vote is unanimous.

•Public input for items not on Agenda: Member of public concerned about amount of chemical treatment in the lakes. Members clarify that next meeting on Request for Amended Order will be on 7-9-19;

•Request for Determination for 106 Plunkett Reservoir Road. Applicant is the Town of Hinsdale.

The Representative from Berkshire Engineering reviewed the plan with the Commission. It was stated that the extent of the work would be cutting & removal of trees, without taking out the stumps.This would allow activities for the capping of the landfill, which is required by MA DEP Division of Solid Waste Management. Mitchell recommends negative determination with the following conditions; Contact Conservation Commission prior to start of work to arrange site inspection of erosion controls to determine whether they are adequate to control any erosion & sedimentation leaving the site to impact wetland resource areas; Follow submitted Landfill sketch plan for installation of erosion controls; Commission will determine whether erosion controls are sufficient at the time of inspection or whether additional controls are necessary.Bruce motions for negative determination with recommended conditions, Cederholm seconds, vote is unanimous.

•File #181-0260, Notice of Intent for Old Dalton Road (Map 405) Applicant is the Town of Hinsdale.

The Representative from Foresight Engineering presented the plan for the replacement of the existing culvert with a partially embedded aluminum structural plate pipe arch with headwalls & wingwalls.The applicant representative reviewed the culvert pipe dimensions, which included a natural streambed substrate and meet the MA River & stream crossings standards to the maximum extent practicable. Members and Agent discuss and decide on following additional conditions; Installation during low flow conditions, Submit Construction work sequence detail, & for wetland replication add native wetland shrubs to wetland replication plan. Bruce motions to issue Order of Conditions with recommended conditions from conservation agent & additional conditions from members, Cederholm seconds, vote is unanimous. The following recommended conditions are part of the special conditions; The contractor shall submit a detailed stream flow dewatering plan prior to construction for approval by conservation commission. The applicant & contractor shall adhere to all information and plans submitted & approved by the conservation commission. The applicant & contractor shall notify conservation commission prior to the start of work to inspect & approve all erosion controls as shown on the submitted plan. The applicant shall meet the General Performance Standards for replication of Bordering Vegetated Wetlands within 2 growing seasons (310 CMR 10:55(4)(b)1-7;

•Enforcement Order Plunkett Reservoir Road; Continued from 4-29-19; Members decide to require Town of Hinsdale to install straw wattles & a temporary berm to protect resource area until Town replaces culvert.

•Enforcement Order issued to Town of Hinsdale for violation at 134 & 80 Maple Street; Members discuss how to resolve enforcement issue at the Town Highway Garage site.  Members decide that a wetlands delineation should be done to define the wetland boundary.  Members agree that a surveyed wetland line done by an engineering firm would permanently define the wetland boundary to prevent future violations.  The issue of cost was discussed by members, and Agent Mitchell mentioned use of Conservation Fund to help pay the cost.  Members open to idea, and request a cost estimate from an engineering firm.

•Correspondence: Notice received from Railroad company for Right of Way maintenance.

    2. Thomas Coote, Discussion of Environmental Assessments of Lakes; Mr Coote, Professor of Environmental Science at Simon Rock College reviewed what could be included in an assessment of Lake ecology. 

 

    3. File #181-77, Request for Amendment for Ashmere Lake Herbicide Treatment.  Applicant is Town of Hinsdale.

 

The applicant’s representative discussed having a follow up survey after initial treatment of Lake, with an additional treatment in July.The Amendment request indicated that the applicant wanted to change the date of the initial treatment from before June 15th to mid-July.However, during the discussion the applicant’s representative stated that they wanted to continue the earlier treatment before June 15th and complete a survey of new growth within the lake, and if necessary follow up with an additional treatment in July, and continue to have a final treatment after Labor day.Mitchell recommended a continuance of Public Hearing until 7-9-19 at town hall meeting room at 6PM with the condition that Solitude will submit a survey of the results of the initial treatment, and a survey of the new growth of warm water species.Bruce motions to continue, Cederholm seconds, vote is unanimous.

 

    4. Request for Determination for 199 Ashmere Road (Map 112, Lot 11) Applicant is Michael & Elizabeth Lansing.

 

The applicant’s representative, SK Design Group, Inc. reviewed the submitted plan.Mark Stinson, DEP Circuit Rider stated that under 310 CMR 10:53(1) the Commission could require plantings of natural vegetation adjacent to resource areas.Cederholm motions for negative determination with following conditions, Installation of erosion controls (straw wattles), notify Commission prior to start of work to inspect erosion controls, installation of drip edge if roof cover over deck not directed towards Lake, submission of planting plan for 3 highbush blueberry near shoreline, Bruce seconds, vote is unanimous.

1.  Review of Minutes from 1-8-19; Bruce motions to approve, Cederholm seconds, vote is unanimous.

2.   Request for Determination for 221 Ashmere Road (Map 112, Lot 15) Applicant is Dolores Edelson. Members discuss conditions for proposed project for addition to existing house; Notify Commission 5 days prior to start of work to inspect erosion controls; All material must be put into dump truck-no storage of material on site; Comply with all plans & information submitted; Inspection after completion of work for approval to remove erosion controls; Bruce motions for negative determination, Cederholm seconds, vote is unanimous.

3.  File #181-0259, Notice of Intent for Plunkett Lake Drawdown off Michaels Road.  Applicant is the Town of Hinsdale.

Mitchell states that he reviewed all of the previous permits (Order of Conditions, Emergency Permit) and information received from Massachusetts Fish & Wildlife & Guidance Report (GEIR Report) from MA Dept of Environmental Protection to determine what conditions were necessary for the Drawdown.  The Commission could issue an Order of Conditions with these conditions. The applicant has complied with the office of dam safety for swing board installation. Members reviewed the proposed conditions and added the condition that anything in these conditions supersedes any contradiction or difference in the Notice of Intent and approved the following conditions:

•Special Conditions MA DEP File # 181-0259

The applicant is allowed to drawdown the Lake water level 34 inches measured from the top of the existing flashboards located at the crest of the dam. (Historically identified as an elevation of 1502)

The Drawdown shall commerce on November 1st to allow sufficient time, and shall be completed by December 1st.

The drawdown rate shall not exceed 4 cfsm as measured at the outlet structure, or not to exceed 3 inches per day.

Once the drawdown has been achieved, the Lake outflow must equal the inflow.

The Lake can be refilled by April 1st or until ice is out of Lake, but must be refilled by April 30th.

During the refill, outflow must be equivalent to 0.5 cfs per square mile of watershed.

A designated individual must maintain a daily log during the drawdown and the refill, and provide this information to the Conservation Commission to comply with the Order of Conditions.  This individual must report any non-compliance within 24 hours to the Commission.  Contact information for the designated individual must be provided to the Commission prior to the start of Drawdown or refill.

Anything in these conditions supersedes any contradiction or difference in the Notice of Intent.

Cederholm motions to issue Order of Conditions with special conditions, Bruce seconds, vote is unanimous.

4.  File #181-0258, Notice of Intent for Line 393 Right of Way located between Adams Road & Substation off New Windsor Road.  Applicant is Eversource Energy.

The Applicant’s representative reviewed the proposed project.  Members decided on the following conditions;

Applicant shall submit Annual Reports, and SWPPP weekly reports

After completion of work, Conservation Commission will inspect restored Riverfront Area to approve removal of erosion controls.

Applicant will adhere & follow all plans & information submitted with NOI, and must notify Commission prior to start of work within wetland resource areas to inspect erosion controls.

Bruce motions to issue Order of Conditions with the special conditions, Cederholm seconds, vote is unanimous.

5.   File #181-208, Request for Certificate of Compliance for 321 Ashmere Road for Estate of Jeanne D. Crawley. Bruce motions for issuance of Certificate of Compliance, Cederholm seconds, vote is unanimous.

3.  Request for Determination of Applicability for 41 Lakeview Circle.  Applicant is Jeff Reinhardt.

Members point out that this application is for the construction of a deck previously, and that it was determined that there were no negative impacts to wetland resource areas.  Bruce motions for negative determination, Cederholm seconds, vote is unanimous.

4.  File #181-0242, Request for Certificate of Compliance for Eversource Energy for Transmission ROW 91551) Off Old Watson Road.

Bruce motions to issue Certificate of Compliance, Cederholm seconds, vote is unanimous.

6.  Enforcement Order issued to the Town of Hinsdale for Plunkett Reservoir Road; Discussion with Town of Hinsdale Road Superintendent, who stated that the Town only installed an extension onto the existing drainage pipe.  Conservation Commission members, Agent, members of select board, and Road Superintendent agree to meet for site visit on Saturday 1-12-19 at 10AM.
