Review & Approval of Minutes of Meeting 6-9-2020: Horton motions to approve, Bruce seconds, vote is unanimous.

•Enforcement Order Plunkett Avenue Extension (Map 102/102, Lots 24/26):  Mitchell states that property owner complied with conditions of enforcement order, and recommends rescinding.  Bruce motions to rescind enforcement order, Horton seconds, vote is unanimous.

•Request for Determination for 89 Creamery Road (Map 406, Lot 50) Applicant is Arthur Erricetto.

Michael Kulig, P.E. present representing applicant. Mr. Kulig reviews site plan and describes proposed project.  Board of Health has approved installation of septic system.  Members conducted site visit to site, and discuss special conditons; Removal of all waste from site, installation of erosion controls, contact Commission to inspect prior to start of work; Notify Commission after completion of work to inspect prior to removal of erosion controls.  Bruce motions for negative determination with conditions, Horton seconds, vote is unanimous.

•Request for Determination for 129 Lenore Drive (Map 411, Lot 100) Applicant is Glen Waller.

Deborah Waller present and describes the dock as a floating dock to be removed seasonally.

Horton motions for negative determination, Bruce seconds, vote is unanimous.

•Request for Determination for 68 Shore Drive (Map 111, Lot 73) Applicant is Anthony Allegrone.

Anthony Allegrone present to answer any questions.  Members discuss site visit to property.  Discussion of which trees will be removed.  The site Plan shows location of erosion controls.  Members discuss conditions for work; Notify Commission prior to start of work to inspect erosion controls; After completion of work, notify commission to conduct inspection to approve removal of erosion controls.  Bruce motions for negative determination with conditions, Horton seconds, vote is unanimous.

•File #181-0252, Request for Certificate of Compliance.  Applicant is Eversource Energy.

Mitchell states that applicant representative requested a continuance until the August conservation Commission meeting.  Koch motions for continuance, Horton seconds, vote is unanimous.

•Discussion and Review of complaint on wetland violation for 450 Michaels Road:  Members directed Agent to draft an Enforcement Order.  Mitchell explained that he only described the activity that was in violation, and the Order required the property owner to cease and desist from any further activity that affected the buffer zone or resource areas.  There were no further requirements within the drafted Order.  Members thought this was reasonable and agreed with the wording of the Order.  Bruce motions to issue the Enforcement Order as worded, Horton seconds, vote is unanimous.

•Interview Richard Litchfield for appointment to the Conservation Commission: Mr. Litchfield was present and answered questions from members of the Commission.

•Interview Ray Huntoon for appointment to the Conservation Commission: Mr. Huntoon was present and answered questions from members of the Commission.

Discussion of each candidate; Bruce motions to recommend Richard Litchfield, Horton seconds, vote is unanimous.

Old/New Business

Update Enforcement Order issued to the Town of Hinsdale for violation at 134 & 80 Maple Street:  Mitchell reports that Foresight Land Services has completed the wetland delineation and survey field work, and working on completing the topographic base map, and wetland replication design.

•EP 20-4, 107 Hemlock Lane: Mitchell conducted site visit with Chair Conry.  Property owner requesting removal of dead trees next to house structure.  Horton motions to ratify, Bruce seconds, vote is unanimous.

•Correspondence: Mitchell reports he received renewal application for Commission membership with MACC.

Meeting called to Order at 6PM

Review & Approval of Minutes of Meeting 5-12-2020: Horton motions to approve, Bruce seconds, vote is unanimous.

Request for Determination for 177 Ashmere Road (Map 112, Lot 7) Applicant is Harris Aaronson.

Emily Stockman of Stockman Associates is present on behalf of the Applicant and states that applicant is requesting approval of wetland delineation of bordering vegetated wetland.  Commission members conducted a site visit to the site to review the delineation in the field.  Delineation will be used for any future plans for the site.  Mitchell explains that the applicant submitted a surveyed plan from Sackett Survey Services, Inc. showing the location of the delineation with flagging. The Determination is valid for three years. 

Horton motions for Positive Determination #2a for confirming the wetland boundary as accurate, Bruce seconds, vote is unanimous.

Enforcement Order 134 & 80 Maple Street issued to the Town of Hinsdale: Mitchell updates the Commission informing them that there is a schedule site visit to conduct exploratory excavation to determine the original grade at the site as part of the plan to complete a wetland boundary delineation at the site. Members are invited to attend.

File #181-0252, Request for Certificate of Compliance. Applicant is Eversource Energy.

Mitchell states that applicant representative did not respond to any recent emails to conduct a site visit.  Members asked what action needed to be occur.  Mitchell stated Commission was not required to take any action, since we were unable to conduct site visit to confirm compliance with the Order of Conditions, and that the item could be put back on the agenda with applicant request.

Enforcement Order 120 Plunkett Avenue Extension: The property owner Richard Litchfield was present and part of the discussion.  Mitchell presented him a copy of the Amended enforcement order with the corrected address and property owner.  Commission conducted a site visit on Saturday 6-6-2020 with Mr. Litchfield.  Horton motioned to ratify the enforcement order and require submission of a restoration plan within two weeks for consideration at the next meeting in July, Bruce seconds, vote is unanimous.

Emergency Permit 374 George Schnopp Road: Mitchell states that he issued an EP to remove two dead trees at the site that were a threat to the home structure.  Horton motions to ratify EP 20-3, Bruce seconds, vote is unanimous.

450 Michaels Road: Mitchell explains that it was an oversight that this wasn’t included on the Agenda. The Commission conducted a site visit 0n May 9, 2020 to investigate a complaint received from MA DEP from an anonymous report. The property owner was cooperative and allowed the commission access to the property and showed Commission members all activities on the property. The location of the complaint was at the dam of the pond & stream channel. The compliant indicated there was a blockage of flow or damming of the stream channel.  The pond had several dead trees, which indicated that the pond may have existed for several years. The stream channel was flowing, but there were indications that the property owner was attempting to repair the dam. Members & Agent stated verbally to the owner to cease & desist from any further activity at the site.  Members agreed/instructed the Agent to draft an enforcement order to be reviewed at the next scheduled meeting, and to notify the property owner that the Commission would be considering approving an enforcement order to  cease & desist order from any further activity at the site at the next schedules meeting and to notify property owner to attend meeting.

  • Correspondence: Mitchell informed members of information on timelines for permits received from MACC; Mitchell informs members of letter sent to applicant at 121 Hemlock Lane reasons for not being able to process Notice of Intent application. (see copy of letter attached to minutes) Mitchell informs received letter from CSX railroad representative informing Commission of Yearly Operational Plan for maintenance of right of way.  Commission members agree to have Agent obtained copy of the YOP.

  • Site Visit 450 Michaels Road:  Discussion of site visit for complaint received through MA DEP Western Regional Office.  Bruce recommends putting this on the next scheduled meeting Agenda, and notifying the property owner.

Brian Hill, Representing Skyview Grove Association describes plan and worked proposed on the site. Members and Agent discussed and decide on special conditions: Install Straw Wattles staked near bank of shoreline and wrap around work area; Notify Conservation Commission to inspect and approve erosion controls prior to the start of work; Clean up any garbage or litter on the site; Notify Conservation Commission after completion of work to inspect and approve removal of erosion controls; All work will be done by hand tools with no machinery. The proposed project is the replacement of an existing retaining wall within 5 feet of the shoreline of the Plunkett Lake. The existing retaining wall is 4’ high with 6” X 6” pressure treated wood.Conservation Commission members discuss options for replacing the retaining wall. Applicant agrees to use natural stone as a replacement. The wall will be 4’ high with a gradual setback of 2’ (45 degree angle). Applicant will install a natural burlap covering after excavation of retaining wall prior to backfilling behind wall. No excavated material to remain on site. Install erosion & sedimentation controls and contact Conservation Commission to inspect for approval prior to start of work.No work is allowed until completion of drawdown.

6. Notice of Intent for 110 Watson Road (Map 405, Lot 41) for lowering of the dam. Applicant is Kimberly Wendling.  (Continued from 8-13-19)

Kristen Connell of Fuss & O’Neill is representing the applicant. Ms. Connell provided a description of the proposed project, which is filed as an Ecological Restoration Limited Project. The project will be a gradual and incremental lowering of the water level of the dam to prevent any downstream flooding. Agent Mitchell provided a review with the following special conditions: Applicant shall notify Commission 2 weeks prior to start of work to arrange site visit to inspect erosion & sedimentation controls; The proposed project shall comply with all of the following sections of the WPA Restoration Project, 310 CMR 10.11, 310 CMR 10,12, 310 CMR 10.13, 310 CMR 10.14, and 310 CMR 10:53(4); Applicant shall comply with any part of these sections of the regulations that apply or are required; If a state permit such as Chapter 253 permit is required, then the work may be subject to MEPA regulations per 301 CMR 11.03(3)(a)4., a reduction in impoundment capacity. The applicant shall comply with all plans and information submitted with the Notice of Intent application; after completion of work, notify Commission to arrange site visit to inspect prior to removal of erosion & sedimentation controls.

2. File #181-0077, & File #260-0014, continued public hearing from 7-9-19 for Request for Amendment for Ashmere Lake Herbicide Treatment.  Applicant is the Town of Hinsdale.

There is no representative from Solitude present at the meeting.Frederick stated Lycott used airboat with jets underneath vessel to spray herbicide directly into water.Frederick asked if there are any other certified operators?

Conry asked about hydroraking, Mitchell stated primarily used in areas of swallow water, doesn’t uproot any plants, only removes excess material.

Frederick states he is not discounting herbicide treatment, since it targets specific species.Koch states the reason not to treat later is because of the camps.

Mason (Select Board Chair) stated that she had contacted Solitude and they acknowledged the problem this year, but they did respond immediately after contacting them.

Frederick motions to continue to 9-10-19, Tremblay seconds, vote is unanimous.

Bruce states the need to contact Solitude of the date, time and place of the next scheduled meeting.

Public Input for items not listed on the Agenda.  Michael Gervasi asked about obtaining certificates of compliance for previous Order of Conditions. Mitchell explained the process and after the meeting is concluded will meet him in the office to see whether certificates of compliance where issued previously.  Jodi Quimette, Lake Management Committee informed the Commission that a Request for an Extension for the Ashmere Lake drawdown will be made for the next meeting.

5. Request for Determination for 0 Peru Road (Map 113, Lot 158) for installation of proposed seasonal dock. Applicant is Thomas Warren.

Jackson Alberti from Foresight Land Services is present to represent the Applicant.Alberti stated that the proposed dock is a temporary seasonal installation and will be removed each year.The proposed dock is aluminum with composite decking reaching 24’ out into Lake with 8 feet sitting on the bottom of the water, so there will be no alteration of Land Under a Waterbody.

6. Notice of Intent for 110 Watson Road (Map 405, Lot 41) Applicant is Kimberly Wendling.

7. Interview Joseph Horton for appointment to the Hinsdale Conservation Commission.

Conry asks why he is interested in becoming a member of the Commission; Horton replies that the environment is important to him, he is an outdoorsman, fly fisherman etc. and he would like to serve the Town, which he lives in full time.

Bruce motions to endorse his candidacy to be appointed by the Select Board, Koch seconds, vote is unanimous.

Chair Frederick from Peru Conservation Commission stated for the record that both the Peru & Hinsdale Conservation Commissions issued Emergency Permits for herbicide treatment of the Lake due to unforeseen circumstances.Frederick also stated that information/spreadsheet for warm and cold water species to be treated (listing of species) was supposed to be provided by Solitude.Frederick said that in lieu of no attendance or information by Solitude, he motions for continuance until August 13, 2019, Tremblay seconds, vote is unanimous.Hinsdale Conservation Commission member Bruce motions for continuance until August 13, 2019, Cederholm seconds, vote is unanimous.

   6. Emergency Permit ratification for File #181-86; Mitchell states that all special conditions of the Order of Conditions were applied to the EP.  Bruce motions to ratify EP, Cederholm seconds, vote is unanimous.

   7. Discussion of Joint Meeting Policy:  Chair Conry stated that she thought it was a good idea to have some rules for joint meetings.  Bruce stated that the rules have to orchestrate the meeting to be fair to both Commissions.  Chair Conry thinks the chair of the host commission should orchestrate the meeting to have questions go through.  Public questions go through the host chair with both Commissions having the capacity to answer questions.  Members agree that the meeting should be orderly without conflict.  There should be equal opportunity to make comments with some kind of time limit.

   8. Discussion, Review, and possible vote of Request for Letter of recommendation for Mallory Marcom.  Due to legal ramifications, there will be no discussion of this item.

   9. Reorganization of Commission/Nomination of Chair/Vice Chair: Bruce motions to nominate Conry to be Commission Chair, Cederholm seconds, vote is 2-0 with 1 abstention.

  10. Enforcement Order Plunkett Reservoir Road; Continued from 4-29-19; Members had decided to require Town of Hinsdale to install straw wattles & a temporary berm to protect resource area until Town replaces culvert.  The Town of Hinsdale did put protections around culvert.

  11. Enforcement Order issued to Town of Hinsdale for violation at 134 & 80 Maple Street; Members discuss how to resolve enforcement issue at the Town Highway Garage site.  Continued discussion of using conservation fund with contribution from Town of Hinsdale to solicit bids from engineering firms to complete survey of wetland line, and conduct site visits with engineers to determine scope of work.  Mitchell submits bid proposal for members to review.  Conry requests motion, Bruce motions to move forward with bid proposal with added line on permanent markers with copy of violation included with bid, Cederholm seconds, vote is unanimous.

  12. Correspondence; Mitchell informs of email received from Eversource regarding RDA for 1185 New Windsor Road for inspection of property at 2PM on 7-11-19;  AE COM representing City of Pittsfield (Cleveland Reservoir Diversion Project File #181-0242) submitted a sequence of work as required, and is in the process of installing erosion controls.
