Meeting called to Order at 6:00 PM

Review & Approval of Minutes of Meeting 11-10-2020: Huntoon motions to approve, Koch seconds, vote is unanimous.

Request for Determination for 724 Middlefield Road (Map 411, Lot 34) for construction of a septic system replacement for an existing failed system. Applicant is Edward F. Barret, Jr.

Mitchell explains that he issued an emergency permit for the work, since they had a failed septic system. Mitchell recommended a negative determination with installation of erosion & sedimentation controls at the end of work line, which is approximately 50 feet from a bordering vegetated wetland.

Huntoon motions for negative determination with installation of erosion controls, Litchfield seconds, vote is unanimous.

Request for Determination for 0 New Windsor Road (Map 405, Lot 90) for installation of a two pole voltage regulator structure. Applicant is Eversource Energy.

Mitchell explains that they are installing the two-pole structure along the shoulder of the road, which is within 10 feet of a bordering vegetated wetland. Huntoon asks why they choose this particular location. Eversource representative stated that they tried to locate it in two other locations, but were able to meet requirements at those locations.

Mitchell recommended negative determination with installation of erosion & sedimentation controls, and inspection of erosion controls prior to the start of work. Huntoon motions for negative determination with those special conditions, Litchfield seconds, vote is unanimous.

File #181-0265, Request in writing to make change to the approved plans per condition number 13. Applicant is Thomas Warren.

Jackson Alberti, Foresight Land Services representing applicant stated that there was a problem with the location of the septic tank at the previous location. They decided with the contractor to move the location of the septic tank to the new location as shown on the amended plan. The tank is a 1000-gallon tight tank that has to be pumped. Mitchell points out that the new location is still within the confines of the location of the erosion & sedimentation controls within the buffer zone of the lake.

Huntoon motioned to allow change in plan, Litchfield seconds, vote is unanimous.

Old/New Business

File #181-0259, Discussion and update on Drawdown of Plunkett Lake. Mitchell provides summary of activity by Town of Hinsdale to comply with the Order of Conditions to draw the Lake down. The concern is potential damage to the batter board system, which could compromise refilling the Lake in the spring. Mitchell also mentioned that he spoke with the Area Director of MASS Fish & Wildlife, who thought that the Town should not drawdown the Lake at this point, since it was too late in the season. Mitchell recommended approving the issuance of an emergency permit due to his concern for the potential damage to the batter board system. Mitchell stated that he if the Commission approves issuance of the emergency permit, he will inform MASS Fish and Wildlife to allow them an opportunity to state their concern to MA DEP, who has the right to appeal an emergency permit issued by the Conservation Commission. Mitchell further states that he included complying with all the special conditions within the Order of Conditions. Huntoon motions to approve issuing an emergency permit Allowing the Town of Hinsdale to draw down the water level of the Lake with special conditions, Litchfield seconds, vote is unanimous.

Emergency Permit 20-11, 724 Middlefield Road; Huntoon motions to ratify emergency permit, Litchfield seconds, vote is unanimous.

Enforcement Order 450 Michaels Road update on site visit on 11-14-2020; Mitchell states that members Huntoon, Litchfield, and Himself visited the site and went to the location of the dam and found that all of the activity was done by beavers, and the property owner wasn’t responsible for any of the activity at the site. There was still flow within the stream channel, since there were leaks in the beaver dam. Therefore, there was not any violation of the enforcement order to cease and desist from any further activity by the property owner.

Update/New Business re: File #181-0244; Mitchell explains that the Commission is re-issuing a copy of the original Order of Conditions, since the applicant never recorded original Order, and has no copy.

Review & Approval of Minutes of Meeting 10-13-2020: Huntoon motions to approve, Koch seconds, vote is unanimous.

File #181-0270, Notice of Intent public hearing for reconstruction of Middlefield Road (from Route 8/South Street to Peru Town line) Applicant is Massachusetts Department of Transportation-Highway Division.

Applicant representative Matthew Kelly made presentation of project plans for the project. Discussion of culvert replacements and reasoning for replacing with Box Culverts to meet stream crossing standards. Review of wetland resource area alterations both temporary and permanent. Project filed as a Limited project. Discussion of stormwater standards as a redevelopment project.

Chair Koch asks if there were any questions or comments from the public. No comments

Huntoon motions to close public hearing, Litchfield seconds, vote is unanimous. Members discuss special conditions for the proposed project.  Agent Mitchell reviewed drafted Special conditions:

 Compliance with all submitted plans & information submitted with NOI application;

Compliance with all conditions of the MA DEP WQC Permit;

Compliance with all conditions of the ACOE Permit;

Compliance with any conditions of NHESP;

Comply with any MEPA regulation requirements;

All temporary wetland resource area impacts that include restoration and replication require monitoring by a professional wetland scientist for a 2 year period.  The wetland scientist shall provide written reports to the Hinsdale Conservation Commission;

The Bordering Vegetated Wetland Replication Area shall comply with 310 CMR 10:55(4)(a)(b)1-7;

All erosion and sedimentation control barriers shall be installed as shown on the submitted plans and be maintained in good repair and inspected and approved by the Hinsdale Conservation Commission or its Agent prior to the start of work.

Equipment maintenance and refueling shall be done 100 feet outside Wetland Resource Areas;

 Huntoon motions to issue Order of Conditions with outlined special conditions, Litchfield seconds, vote is unanimous.

Request for Determination for 184 Shore Drive (Map 112, Lot 283) Applicant is Mark Mcllquham.

Applicant stated that he was requesting the removal of Pine and Poplar trees along the boundary line of his property as well as the abutter because several trees have already fallen down during storms and came close to falling on their houses. Mitchell recommended allowing trees to be cut down to ground level without removing stumps or disturbing ground. Applicant thought this was reasonable and they intend to plant lilacs or other low growing shrubs.

Huntoon motions for negative determination approving removal/cutting of trees to ground level without removing stumps or disturbing ground, Litchfield seconds, vote is unanimous.

File #181-0268, Request in writing to make minor change to the approved plans per condition number 13. Applicant is Thomas Dion.

Commission members reviewed information showing change in plan from applicant, and determined that it was an improvement and a minor change.

Update on enforcement order issued to Town of Hinsdale for violation at 134 & 80 Maple Street: Mitchell states wetland restoration plan will be done in the Spring

Correspondence: Koch informs members of receipt of letter regarding 450 Michaels Road. Mitchell explained that Commission had received complaint from MA DEP in May 2020, and scheduled a site visit with property owner. Members toured property and found a combination of man-made/beaver dam, which had come apart allowing flow of water into stream channel (Russo Brook) members had Agent draft enforcement order, which was approved as written. Members agreed to have Agent contact property owner to schedule a follow up site visit to the site.

Koch discussed sending letter to property owner on Lenore Drive where clearing of vegetation was done down near Lake. The letter would outline when a permit is required.

Applicant’s representative, Hill Engineering reviews submitted plans for the proposed project. Members have concern over potential alteration of bordering vegetated wetlands. Discussion of having a conservation buffer zone of 20 feet along wetland line surveyed and marked with conservation markers to protect resource area. The other concern is location of pathway to boardwalk to dock. Representative states that boardwalk will be elevated above ground through bvw. The other concern is removal of tree canopy. Emily Stockman of Stockman Associates is present on behalf of the Applicant and states that applicant is requesting approval of wetland delineation of bordering vegetated wetland.  Commission members conducted a site visit to the site to review the delineation in the field.  Delineation will be used for any future plans for the site.  Mitchell explains that the applicant submitted a surveyed plan from Sackett Survey Services, Inc. showing the location of the delineation with flagging. The Determination is valid for three years. 

Horton motions for Positive Determination #2a for confirming the wetland boundary as accurate, Bruce seconds, vote is unanimous.

Enforcement Order 134 & 80 Maple Street issued to the Town of Hinsdale: Mitchell updates the Commission informing them that there is a schedule site visit to conduct exploratory excavation to determine the original grade at the site as part of the plan to complete a wetland boundary delineation at the site. Members are invited to attend.

Mitchell states that applicant representative did not respond to any recent emails to conduct a site visit.  Members asked what action needed to be occur.  Mitchell stated Commission was not required to take any action, since we were unable to conduct site visit to confirm compliance with the Order of Conditions, and that the item could be put back on the agenda with applicant request.

Enforcement Order 120 Plunkett Avenue Extension: The property owner Richard Litchfield was present and part of the discussion.  Mitchell presented him a copy of the Amended enforcement order with the corrected address and property owner.  Commission conducted a site visit on Saturday 6-6-2020 with Mr. Litchfield.  Horton motioned to ratify the enforcement order and require submission of a restoration plan within two weeks for consideration at the next meeting in July, Bruce seconds, vote is unanimous.

Emergency Permit 374 George Schnopp Road: Mitchell states that he issued an EP to remove two dead trees at the site that were a threat to the home structure.  Horton motions to ratify EP 20-3, Bruce seconds, vote is unanimous.

450 Michaels Road: Mitchell explains that it was an oversight that this wasn’t included on the Agenda. The Commission conducted a site visit 0n May 9, 2020 to investigate a complaint received from MA DEP from an anonymous report. The property owner was cooperative and allowed the commission access to the property and showed Commission members all activities on the property. The location of the complaint was at the dam of the pond & stream channel. The compliant indicated there was a blockage of flow or damming of the stream channel.  The pond had several dead trees, which indicated that the pond may have existed for several years. The stream channel was flowing, but there were indications that the property owner was attempting to repair the dam. Members & Agent stated verbally to the owner to cease & desist from any further activity at the site.  Members agreed/instructed the Agent to draft an enforcement order to be reviewed at the next scheduled meeting, and to notify the property owner that the Commission would be considering approving an enforcement order to  cease & desist order from any further activity at the site at the next schedules meeting and to notify property owner to attend meeting.

Brian Hill, Representing Skyview Grove Association describes plan and worked proposed on the site. Members and Agent discussed and decide on special conditions: Install Straw Wattles staked near bank of shoreline and wrap around work area; Notify Conservation Commission to inspect and approve erosion controls prior to the start of work; Clean up any garbage or litter on the site; Notify Conservation Commission after completion of work to inspect and approve removal of erosion controls; All work will be done by hand tools with no machinery.
